By accessing or using any part of the Cold Ischemia Foundation website, tools, or membership services located at coldischemia.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Site or its services. These terms apply to all visitors, users, and members.
The Cold Ischemia Foundation is a nonprofit advocacy organization dedicated to supporting care partners and caregivers navigating chronic illness, kidney disease, and transplant medicine. We develop educational resources, policy advocacy tools, and AI-powered instruments designed to help caregivers understand their rights and protect their wellbeing. We are not a healthcare provider, medical organization, or licensed clinical practice of any kind.
Nothing on this Site — including our tools, articles, resources, or AI-generated content — constitutes medical advice, legal advice, clinical diagnosis, or treatment recommendations. All content is provided for informational and educational purposes only. You should always consult a qualified healthcare provider, licensed attorney, or other appropriate professional before making any decision affecting your health, legal rights, or financial situation. Use of our tools does not create a provider-patient or attorney-client relationship of any kind.
Certain areas of the Site and certain tools are available only to registered members with active paid memberships. Membership fees are processed securely through Stripe. By purchasing a membership, you authorize Cold Ischemia Foundation to charge your payment method at the frequency and amount selected at the time of purchase. All fees are in US dollars unless otherwise stated.
Memberships automatically renew unless cancelled before the renewal date. You may cancel your membership at any time by accessing your account settings or contacting us at the email address below. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except where required by applicable law.
All membership purchases are final. We do not offer refunds once a billing period has begun. If you believe a charge was made in error, contact us within 7 days of the charge and we will review your request. We reserve the right to grant or deny refund requests at our sole discretion.
To access paid content and tools, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect unauthorized use of your account. Cold Ischemia Foundation is not liable for any loss or damage resulting from unauthorized account access caused by your failure to protect your credentials.
You agree to use the Site and its tools only for lawful purposes and in ways consistent with these Terms. You may not use the Site to distribute harmful, fraudulent, or deceptive content; attempt to gain unauthorized access to any portion of the Site; interfere with the operation of the Site or any connected systems; scrape, copy, or reproduce our proprietary tools or content without written permission; or impersonate any person or organization.
All content on this Site — including but not limited to the five care partner tools (Relationship Cartography Engine, Narrative Mirror, Two Futures Engine, SIGNAL, and MERIDIAN), written materials, design, code, and branding — is the intellectual property of the Cold Ischemia Foundation and is protected by applicable copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works from any of our content without prior written consent.
Several of our tools use artificial intelligence to generate personalized written outputs based on your inputs. These outputs are generated in real time and are not reviewed or verified by Cold Ischemia Foundation staff before delivery. AI-generated content is provided for reflective and educational purposes only and does not constitute professional advice of any kind. You retain responsibility for how you use or act on any AI-generated content produced by our tools.
To the fullest extent permitted by applicable law, Cold Ischemia Foundation and its officers, directors, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site or its services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to us in the twelve months preceding the claim.
The Site and all its content and tools are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Cold Ischemia Foundation does not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We make no warranty that any content or tool output is accurate, complete, or suitable for any particular purpose.
Our Site uses third-party services including Stripe for payment processing, Memberstack for membership management, and Anthropic's API for AI-powered tool functionality. Your use of these services is also subject to their respective terms and privacy policies. Cold Ischemia Foundation is not responsible for the practices or content of third-party services.
We reserve the right to update or modify these Terms of Service at any time. When we make material changes, we will update the effective date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the updated terms. We encourage you to review these terms periodically.
